International child support
Our team regularly assists and advises our clients with matters of international child support, both outside of Court in dealing with the Child Support Agency (Services Australia) and reciprocating jurisdictions.
We help with circumstances including:
- Contested applications in the Federal Circuit and Family Court of Australia;
- Negotiating agreements (for example a Binding Child Support Agreement of Limited Child Support Agreement) where the parties agree to depart from a child support assessment;
- Clarification of how to share expenses of children (for example health insurance, out of pocket medical fees, extra-curricular activities and schooling expenses); and
- Non-compliance with Binding Child Support Agreements.

International travel or relocation of children
Whether you are the parent who wishes to travel or relocate outside of Australia with your child/ren, or you have concerns about travel or relocation of your child/ren outside of Australia, our lawyers have particular expertise in these matters.

- Advice about temporary & permanent relocation of children outside of Australia;

International child abduction & Recovery Orders

If your child has been taken overseas without your consent, actioning International Child Abduction Hague Proceedings will be necessary.
If you believe there is an imminent risk of international abduction, for travel or relocation, seek legal advice. A lawyer highly experienced in Recovery Orders will be able to advise you of what, if anything, to do.

Non-compliance with Orders
When Orders are made by the Court, there is a requirement for all parties to comply. If Parenting Orders or Property Orders have been contravened, there are opportunities for the affected party/parties to make an application/s to the Court. These are referred to as Contravention Proceedings.
The Court (Federal Circuit and Family Court of Australia) takes any contravention of Orders seriously, and as a result has developed a National Contravention List to deal with these types of matters, with the aim being a swift resolution, and to deter non-compliance in the future.
Generally speaking, within 14 days after filing the application, the Court will have listed a date for the issue/s to be resolved.
Contravention applications are serious and must be completed correctly. Our team is highly skilled in applications and opposing such applications.
